360 AI Research Product License and Terms of Use

These Terms govern your use of 360 AI Research products and related services, including license scope, acceptable use, AI features, and liability.

Welcome to 360 AI Research. Please read this 360 AI Research Product License and Terms of Use (the “Agreement”) carefully. In particular, please review the provisions shown in bold that exclude or limit liability. You may use 360 AI Research and its related services (collectively, the “Product”) only if you accept this Agreement. By accessing or otherwise using the Product, you agree to be bound by this Agreement. If you do not agree, do not use the Product.

If you do not have full civil capacity because of your age, intellectual ability, or another reason, please read this Agreement with your legal guardian and decide with your guardian whether to accept it.

This Agreement is a legal agreement between you and Beijing Qihu Technology Co., Ltd. and its affiliates (collectively, “360”) concerning your download, installation, use, and copying of the Product.

01Services and Scope of License

1.1

The Product conducts frontier research in multimodal understanding and generation and provides innovative AI solutions. Some features may be enabled or disabled by default, and you may configure them in the Product. 360 may continually improve its features and services. Available services may vary by region because of operational arrangements, regulatory requirements, or business strategy; the services actually made available to you will govern.

1.2

You may use the Product for non-commercial purposes as described in the Product. 360 grants you a personal, non-transferable, non-exclusive license to use the Product only within the scope and in the manner permitted by this Agreement and other applicable 360 agreements, instructions, and rules.

1.3

Obtain the Product only from an official 360 website or an authorized third party. If you obtain it from an unauthorized source, 360 cannot guarantee that it will work properly and is not liable for losses arising from that source.

1.4

360 provides only the services covered by this Agreement. You are responsible for the devices, network access, data plans, telecommunications charges, and other costs required to use the Product.

1.5

All rights not expressly granted under this Agreement are reserved by 360. You must obtain separate written permission before exercising any reserved right. A failure by 360 to exercise a right does not waive that right.

02Account Registration and Use

2.1

You may need to register an account to use the Product. You must also read and comply with any separate agreement governing that account.

2.2

Where required by law, 360 may require registration and sign-in before you use functions such as viewing, caching, saving, commenting, or sharing. Without signing in, some functions may be unavailable.

2.3

The Product may support sign-in through a third-party account. With your authorization, 360 may obtain the account information needed to complete that sign-in.

2.4

When registering, you must follow the registration rules and provide true, accurate, lawful, valid, and complete information required by the registration or sign-in page so that legal requirements can be met and 360 or relevant third parties can contact you when necessary.

2.5

You must keep your registration information complete, accurate, and up to date and are responsible for its authenticity, accuracy, lawfulness, and validity. You are responsible for issues caused by false information or impersonation and must compensate 360 or a third party for resulting infringement or loss.

2.6

Your username, avatar, profile, and other registration information must not contain illegal or harmful content, impersonate or misuse the identity of an organization or public figure, or infringe copyright, trademark, or other lawful rights.

2.7

360 may review submitted materials and decide whether to approve registration. Incomplete or inaccurate information may prevent registration, restrict access, or make some services unavailable.

2.8

Where needed to comply with law or protect account security, you authorize 360 to verify information you provide, such as a mobile number or identity-document number, through competent public authorities, telecommunications operators, financial-service institutions, or other authoritative sources, as permitted by law.

2.9

You are responsible for all activity under your account. Keep your account credentials secure and do not disclose them to others. Notify 360 promptly if you know or suspect that your account has been used without authorization. You bear losses caused by your own fault, credential sharing or transfer, disclosure, malware, or compromise of your device, except where applicable law provides otherwise.

2.10

You must not give away, share, lend, lease, transfer, or sell an account. For a violation, 360 may suspend the account, require corrective action, terminate services, or cancel the account; you bear the resulting consequences.

2.11

You must not maliciously register accounts for profit, speculation, cash conversion, or another improper purpose, and must not misappropriate another user's account.

2.12

Immediately notify 360 if you discover unauthorized account use or a security vulnerability.

2.13

To close an account, follow 360's published application and review process. Closing an account does not release obligations incurred while using the Product. Account data, functions, and records cannot be restored after closure, so use this function carefully.

2.14

360 owns the account. After registration is approved, you receive only a right to use it. 360 may recover the account as required by law, a regulator, or legitimate operational needs.

2.15

If an account name violates law or 360's account-name rules, 360 may suspend the account, require correction, terminate services, cancel the account, and report the matter to competent authorities. You bear consequences such as interrupted communications, removal of content or data, and forfeiture of proceeds.

2.16

If you do not sign in or use the account for more than six consecutive months after registration, 360 may freeze or recover it as allowed by law and platform rules. Saved information and usage records may then become unrecoverable, unless law provides otherwise. 360 will provide an appropriate reminder before freezing or recovery.

03Acceptable Use

3.1

360 may send service announcements, order information, promotions, advertising, and other notices by email, SMS, telephone, in-product message, pop-up, or client notification. Where a notice may be opted out of, 360 will provide a way to do so.

3.2

A specific service may have separate terms or business rules. Read and accept those terms before using that service.

3.3

Minors should use the Product under the guidance of a parent, guardian, or teacher, avoid excessive use, and protect their personal information. A minor and the minor's guardian bear legal responsibility as prescribed by law for violations.

3.4

You decide whether to use a third-party product, website, or resource recommended or linked by 360 and should do so carefully. Unless law provides otherwise, 360 does not control or assume responsibility for third-party content, privacy practices, or activities. Review the third party's terms and privacy policy before leaving the Product.

3.5

The Product may display information-distribution, brand-promotion, or other advertising content from 360 or third parties. Evaluate third-party advertising carefully. 360 gives no warranty for third-party goods or services and is not a party to disputes concerning them, except where law provides otherwise.

3.6

360, or a third party authorized by you, may send or display commercial and non-commercial information through SMS, email, or electronic messages. You are responsible for evaluating the authenticity and reliability of advertising and, except where law provides otherwise, for actions you take in reliance on it.

3.7

The Product may display or link to third-party services for convenience. 360 does not operate or warrant those services. Contact the third-party provider directly to resolve a dispute.

3.8

When using a third-party product or service through the Product, you must comply with both this Agreement and the third party's terms. Each party is responsible within the scope provided by law and contract.

3.9

You must comply with the Constitution and applicable laws and regulations of the People's Republic of China, including laws concerning state secrets, copyright, computer and network security, software, online publications, dissemination of information online, personal information protection, cybersecurity, data security, and protection of heroes and martyrs. You must respect public order and social ethics and must not use the Product to endanger national security, honor, or interests; undermine state power or national unity; promote terrorism, extremism, ethnic hatred, discrimination, violence, obscenity, or pornography; fabricate or disseminate false information that disrupts economic or social order; or infringe reputation, privacy, intellectual property, or other lawful rights. If 360 reasonably believes that such conduct has occurred, it may terminate service without prior notice.

3.10

You may upload or publish only content that you created or are lawfully authorized to use, including opinions, data, text, usernames, images, personal information, audio, video, and links. Your use must not infringe a third party's rights. Reviews and similar content must be objective and authentic and must not be manipulated for payment or another benefit, used to threaten a merchant, or otherwise disrupt the Product's normal operation.

3.11

When using the Product, you must comply with applicable laws, network-service protocols and procedures; use the service only for lawful purposes; avoid conduct that adversely affects the internet or a mobile network; refrain from uploading, displaying, or distributing false, harassing, insulting, defamatory, threatening, vulgar, obscene, or otherwise unlawful material; respect 360's and third parties' lawful rights; refrain from conduct adverse to 360; and report unauthorized account use or security vulnerabilities promptly.

3.12

Even with 360's written permission to share or repost Product content, you must not disclose search terms, hit rates, categories, search volume, clicks, reading statistics, or similar data without prior written consent; alter, obscure, insert into, or interfere with a source page; permit unauthorized automated collection such as spiders; sell, commercially exploit, disclose, or allow use outside the permitted scope; or violate any other published 360 sharing standard.

3.13

You must not use the Product for sexual, suggestive, vulgar, or superstitious content; unauthorized commercial promotion, spam, or harassment; unlawful disclosure of privacy or personal information; infringement of reputation, likeness, intellectual property, trade secrets, or other rights; interference with Product operations; false information or impersonation; forced or deceptive clicks or sharing; misleading conduct; unauthorized plug-ins or external tools; criminal activity or tools that enable it; or any other conduct that violates law, this Agreement, user rights, 360's operations, or Product rules.

3.14

You must not use the Product to publish or distribute content prohibited by law or administrative regulation, including content that violates constitutional principles; harms national unity, sovereignty, territorial integrity, security, honor, or interests; discloses state secrets; incites ethnic hatred or discrimination; undermines ethnic customs or solidarity; promotes cults, superstition, obscenity, pornography, gambling, violence, or crime; spreads rumors or disrupts public order; insults or defames others; infringes lawful rights; violates social morality; or is otherwise prohibited by the state.

3.15

You must not compromise network security by unlawfully accessing or interfering with a network, stealing network data, supplying intrusion or attack tools, assisting known attacks, using unauthorized data or systems, deleting or altering stored information without permission, probing or testing vulnerabilities without authorization, disrupting systems, distributing malware, forging TCP/IP packet information, reverse engineering or attempting to discover source code, maliciously registering accounts, or otherwise violating cybersecurity law or third-party rights.

3.16

Without 360's written permission and other required authorization, you must not manually or automatically copy, read, or use Product content for promotion or other commercial purposes; edit, organize, or display it outside its source page; divert, hijack, or manipulate traffic or readership through special identifiers, code, or another method; or otherwise obtain Product content unlawfully.

3.17

You must not defeat the service's content-safety or risk-control mechanisms, including by using variants, garbled text, homophones, or other evasions to produce unlawful statements; impersonation, reverse inducement, prompt-injection or jailbreak attacks, or poisoning; deleting, altering, or concealing visible or embedded AI-generated-content labels; or other adversarial conduct.

3.18

Without authorization, you must not use third-party software, plug-ins, extensions, or systems to view or obtain information or data belonging to 360, its partners, or users. You must comply with 360's robots.txt rules and other published protocols.

3.19

You must not misuse the Product, including by registering multiple accounts for profit, speculation, cash conversion, prizes, or another improper purpose, or by using another user's account.

3.20

You must not use or register any trademark, service mark, trade name, domain name, website name, brand, or other right of 360, an affiliate, or the Product without prior written consent, or represent that you are authorized to use or dispose of such rights. You are responsible for resulting losses.

3.21

360 may update the Product or change features to improve experience, security, and consistency. The Product may update automatically. Older versions may stop working or receiving support and maintenance; check for and use the latest version.

3.22

Copies obtained from an unofficial source may contain viruses, Trojan horses, or hacking software and create unpredictable risks. You should not use such copies, and 360 is not responsible for resulting losses.

3.23

To improve user experience, 360 may count how often Product features are used. These statistics concern Product functions and do not include users' personal data. Server page-request counts may be used to calculate these statistics and improve product quality.

3.24

If the program encounters an error or crash, it may create an error log. When a log needs to be sent to the 360 Security Center, the Product will ask for your consent. If you decline, it will not be sent. The log records program error and runtime information and is not intended to contain personal data.

3.25

You may stop using the Product at any time.

3.26

If you stop using the Product or a service is terminated or cancelled, 360 may permanently delete your data from its servers. Back up important data yourself. After termination or cancellation, 360 has no obligation to return data unless law provides otherwise.

3.27

Notify 360 promptly if you discover content that violates law or this Agreement. If your personal information is misappropriated or your copyright or another right is infringed, follow the published complaint process; 360 will assist after receiving the report.

04Use of AI Features

4.1

You may submit text, audio, or other content or information (“Input”) and receive content generated or synthesized in response (“Output”). You must not disrupt the service, induce it to generate content that violates law, social ethics, or public order and good morals, or infringe another person's intellectual property or other rights. Do not disclose or use confidential information, important data, sensitive information, or private personal information concerning yourself or another person. If 360 identifies unlawful content or receives a report of a violation, it may process the content and suspend or terminate some or all services without prior notice, as permitted by law.

4.2

The service may provide the same Output to different users. Except where applicable law or a valid agreement provides otherwise, you have no exclusive right in such Output and must not restrict another user's use of it.

4.3

If Output violates content rules or law or infringes your rights, you may complain or report it through the channels in this Agreement. 360 will investigate and ordinarily respond within 15 business days. You may be asked to provide supporting materials.

4.4

When providing generative AI services, 360 will add labels to generated or synthesized content as required by law, including an explicit label that users can readily perceive, such as “AI-generated,” and an implicit label embedded in the file data that may not be readily perceptible.

4.5

Where 360 provides generated or synthesized content with an explicit label, you may request a version without that explicit label. 360 will handle the request in accordance with applicable law.

4.6

You must create, copy, publish, and distribute AI-generated or synthesized content in compliance with applicable law, including by declaring and prominently labeling it where required. You must not maliciously remove, alter, forge, or conceal an AI label; provide tools or services for others to do so; or use deceptive labels to harm lawful rights. Follow mandatory national standards, current legal requirements, and 360's published labeling rules. You bear liability for a failure to label. In a serious case, 360 may restrict functions or disable your account and may recover resulting losses. Refer to the applicable national-standard information at the National Standard Information Public Service Platform; later requirements supersede earlier ones.

4.7

You must not use deep learning, virtual reality, generative AI, or another new technology to create or distribute false news or other content prohibited by law or platform rules, or misrepresent synthesized content as authentic or naturally occurring. Non-authentic information created using such technology must be prominently labeled. Otherwise, 360 may add a label, restrict or block the content, restrict the account, or take another appropriate measure.

05Privacy

5.1

You may need to provide, or the Product may need to obtain, information necessary to provide Product functions and services. 360 may retain necessary information and send function- or service-related communications. The Product is not intended to contain malicious code that destroys your data or obtains private information, or code designed to monitor or surveil you. 360 will not transfer or disclose your personal information to a third party except where required by law, a judicial or administrative authority; necessary for a merger, separation, acquisition, asset transfer, or business change; necessary to provide a service you request; or permitted by you or another applicable agreement or rule.

06Intellectual Property and Other Rights

6.1

All intellectual property in the Product and its information and content—including text and combinations of text, icons, graphics, images, charts, colors, interface designs, layouts, data, add-on programs, printed materials, and electronic documents—is owned by 360 and protected by copyright, international copyright treaties, and other intellectual-property laws.

6.2

Content in the Product and services that you did not provide is protected by applicable copyright conventions and PRC copyright, trademark, patent, and other laws. Without 360's or the relevant rights holder's consent, you must not use it for a commercial or non-commercial purpose.

6.3

Rights in software and products used to provide the Product—including images, photographs, animation, video, audio, music, text, add-on programs, and help materials—belong to their copyright holders. Without permission, you must not reverse engineer, decompile, or disassemble them.

6.4

As between you and 360, and to the extent permitted by law, intellectual-property rights in your Input remain with you or the relevant lawful rights holder. If Input or Output contains material in which 360 owns intellectual property or another lawful right, that right remains with 360 and is not transferred merely because the material appears in the Input or Output.

6.5

You represent that content you submit or ask the service to process is original to you or lawfully authorized and does not infringe reputation, name, likeness, privacy, copyright, trademark, patent, trade-secret, or other rights. You bear disputes and risks arising from a breach. To provide the service, 360 and any technical service provider supporting it may store, process, and transmit that content only as permitted by applicable law and for purposes necessary to provide the service.

6.6

For information that you input, generate, publish, or distribute through the Product, you grant 360 and its affiliates a royalty-free, worldwide, perpetual, transferable, sublicensable license to store, use, reproduce, revise, edit, publish, display, translate, distribute, and create derivative works from that information for purposes including model and service improvement, research, brand promotion, marketing, and user research, to the extent permitted by law.

6.7

You must not remove or alter electronic rights-management information; circumvent or defeat copyright-protection measures; use the Product to mislead, defraud, or commit an offence; unlawfully delete, alter, add to, or interfere with Product functions, systems, stored or transmitted data, or applications; access a network or network resource without permission; distribute destructive programs; or otherwise endanger information-network security.

6.8

You must not reverse engineer, decompile, or disassemble the Product or alter resources compiled into its program files, except to the limited extent an applicable law expressly permits those activities notwithstanding this restriction.

6.9

The Product is licensed as a single product. You must not separate its components, including software, electronic documents, copyrights, trademarks, this Agreement, or notices, for any purpose.

6.10

Without 360's prior written consent and license, you must not commercially sell, copy, or distribute the Product.

6.11

All rights not expressly granted remain with 360. Written consent is required before you exercise another right.

07Disclaimers and Limitation of Liability

7.1

Because Output is generated by an AI model, you acknowledge that: (a) current technology cannot guarantee accuracy, completeness, timeliness, or availability, and Output may contain factual, opinion, or value-based defects; (b) Output is for reference only, does not represent 360's views, and is not advice—consult a qualified professional for medical, legal, financial, investment, or other professional matters; and (c) Output may be sensitive, unreasonable, or ambiguous. If you publish or share Output, label it prominently as AI-generated and assume responsibility for that publication or sharing.

7.2

You understand the Product's functions and necessary operations and choose voluntarily whether to use them. To the extent permitted by law, you assume the risks and consequences of your use.

7.3

The Product is provided on an “as is” and “as available” basis using currently available technology and conditions. 360 will use reasonable efforts to maintain continuity and security but cannot always foresee or prevent legal, technical, and other risks, including force majeure, malware, hacking, system instability, third-party service defects, governmental action, service interruption, or data loss.

7.4

360 does not warrant that network services will meet every requirement or be uninterrupted, timely, secure, or accurate. You must independently evaluate illegal, unethical, inaccurate, misclassified, deceptive, or otherwise inappropriate information. To the extent permitted by law, 360 is not liable for an error, omission, loss, or injury arising from information published, messaged, transmitted, or otherwise made available through or outside the Product.

7.5

Unless otherwise agreed, 360 makes no express or implied warranty concerning merchantability, fitness for a particular purpose, freedom from error or omission, continuity, accuracy, or reliability. It does not warrant the effectiveness, accuracy, correctness, reliability, stability, completeness, or timeliness of technology or information involved in the service.

7.6

360 does not warrant the accuracy, validity, completeness, availability, or accessibility of external links or content on websites, software, players, or resources that 360 does not control.

7.7

The Product has been tested in detail but may not be compatible with every hardware or software system and may contain errors. Contact 360 for support; if a compatibility issue cannot be resolved, you may stop using the Product.

7.8

The Product may call a third-party system to support a requested function. The third party provides the result. 360 does not warrant the security, accuracy, or effectiveness of that result and, to the extent permitted by law, is not responsible for disputes or damage arising from the third-party system.

7.9

Force majeure may affect the Product, including natural disasters, epidemics, war, civil disorder, governmental action, hacking, material telecommunications changes, temporary closure caused by regulation, and malware. 360 will use reasonable efforts to coordinate a timely response but is not liable for resulting loss to the extent permitted by law.

7.10

Online information and other users' conduct create risks, including anonymous or impersonated threatening, defamatory, offensive, or unlawful messages; deception that causes or may cause psychological, physical, or economic harm; and other risks arising from online information or user conduct. To the extent permitted by law, 360 is not responsible for the truth, suitability, or lawfulness of that information or for infringement by another user.

7.11

To the extent permitted by law, 360 is not responsible for interruption or obstruction caused by a telecommunications or internet failure; device failure, data corruption or loss, malware, or hacking; failure of your or 360's software, system, hardware, or communication line; improper operation or unauthorized use; outdated software, aging equipment, or incompatibility; or another event outside 360's control or reasonable foresight.

7.12

360 is not responsible for deletion of, or a failure to store, your Product data. 360 may set retention periods and storage limits as permitted by law and operational requirements. You are responsible for maintaining your own backups.

7.13

360 may temporarily or permanently discontinue some or all services in response to changes in law, business conditions, or business strategy, subject to applicable law.

08Breach and Remedies

8.1

If you breach this Agreement, or 360 detects an abnormality in the service, 360 may suspend the license, stop providing service, restrict use, pursue legal remedies, or take another appropriate measure. You bear losses caused by a lawful measure taken in response to your breach of law, this Agreement, or another applicable 360 agreement or rule.

8.2

To the maximum extent permitted by law, 360 is not liable for indirect, consequential, punitive, incidental, special, or exemplary damages, including personal loss, loss of business profit, interruption of trade, loss of business information, or another economic loss arising from use of or inability to use the Product.

8.3

If 360 reasonably determines, based on its own findings, information from an authority, or a rights holder's complaint, that you may have infringed lawful rights, 360 may require immediate replacement or modification of the relevant content; close new-user access or restrict existing-user access; remove the relevant product from service; pursue legal liability; publish information about the conduct or provide valid identifying information to a competent authority or rights holder; prohibit future access to platform services; or take another measure it considers appropriate and lawful.

09Contract Location, Governing Law, and Disputes

9.1

This Agreement is entered into in Chaoyang District, Beijing, People's Republic of China.

9.2

This Agreement is governed by the laws of Mainland China, excluding for this purpose the laws of the Hong Kong Special Administrative Region, the Macao Special Administrative Region, and Taiwan. The parties should first attempt to resolve a dispute arising from or relating to this Agreement through good-faith consultation. If consultation fails, the dispute shall be submitted to a court of competent jurisdiction at the defendant's domicile.

10Notices

10.1

360 may give notice under this Agreement through an in-product announcement, email, SMS, ordinary mail, or another reasonable method. A notice is deemed delivered on the date it is sent, subject to applicable law.

10.2

For a dispute arising from your Product activity, you agree that 360 and judicial authorities, including a people's court, may serve complaint documents and legal process by SMS, email, postal mail, or another method permitted by procedural law. The mobile number and email address you register or update are your designated electronic service addresses. Your statutory contact address or another valid address you provide is your designated postal address.

10.3

A judicial authority may use one or more methods permitted by procedural law. If it uses multiple methods, the earliest effective service time governs.

10.4

You must provide accurate, valid contact details and update them promptly. You bear legal consequences caused by inaccurate details or failure to report a change.

11Miscellaneous

11.1

If a provision of this Agreement is wholly or partly invalid, unenforceable, or contrary to applicable law, that provision will be severed to that extent and the remaining provisions remain valid and binding.

11.2

360 may amend this Agreement in response to changes in law, business conditions, or business strategy. The amended Agreement will be published promptly and may accompany a new Product version. The latest text governs a dispute. If you do not agree to an amendment, you may uninstall and delete the Product. Continued use after the amendment takes effect constitutes acceptance.

11.3

This Agreement incorporates the 360 User Service Agreement, any attachments and rules referenced here, and other Product agreements and rules that 360 may publish. Once officially published, those materials form an integral part of this Agreement.

11.4

For Product questions or suggestions, contact 360 at kefu@360.cn, or by mail at: 360 Company, Electronic City International Electronics Headquarters, Courtyard 6, Jiuxianqiao Road, Chaoyang District, Beijing 100015, China. 360 will ordinarily respond within 15 business days. A written notice submitted outside these designated channels may not be treated as valid, and 360 may decline to process it to the extent permitted by law.

11.5

To the maximum extent permitted by law, 360 reserves the right to interpret and amend this Agreement.
